Conditions of the Smile Kitchen Limited’s 25-Year Guarantee (“Guarantee”)
– For the purposes of this Guarantee, ”Eligible Smile Kitchens Furniture” means Smile Kitchens furniture components purchased and supplied within the United Kingdom, including cabinets, doors, drawer fronts, drawer boxes, hinges, drawer runners, shelving, fascias, end panels and trims.
– Eligible Smile Kitchens Furniture does not include worktops, sinks, taps, lighting, appliances and other third-party products, which are excluded from this Guarantee and are covered by the relevant manufacturer’s warranty where applicable.
– The Guarantee applies only to Eligible Smile Kitchens Furniture.
– The Guarantee applies only where the products have been purchased by a consumer for private use and are used under normal domestic residential conditions.
The Guarantee applies only where the Eligible Smile Kitchens Furniture remains installed within the United Kingdom.
– The guarantee applies only to the original purchaser and is not transferable.
– The Guarantee covers defects arising solely from faulty materials or manufacturing workmanship in Eligible Smile Kitchens Furniture.
– The customer must take reasonable care of the products and follow any care, maintenance and cleaning instructions supplied by Smile Kitchens and must ensure that any Eligible Smike Kitchens Furniture is installed in accordance with any installation, care and maintenance instructions supplied by Smile Kitchens.
– Claims must be notified to Smile Kitchens as soon as reasonably practicable after the defect is discovered. Smile Kitchens may reasonably require photographs, proof of purchase, supporting information and reasonable access to inspect the product before determining a claim.
– If you do not allow a Smile Kitchens’ representative to review the Eligible Smile Kitchens Furniture which is the subject of the guarantee claim, then you may invalidate the claim in respect of that Eligible Smile Kitchen Furniture.
– Smile Kitchens reserves the right to inspect, or require the return of, any allegedly defective component before approving a claim.
– The guarantee covers defects arising solely from faulty materials or manufacturing workmanship in Eligible Smile Kitchens Furniture. It does not cover defects arising from installation workmanship.
The Guarantee Does Not Apply To:
– Damage or defects resulting from incorrect installation, planning, misuse, abuse, neglect or accidental damage.
– Damage arising from alterations, modifications or repairs carried out by anyone other than Smile Kitchens or its authorised representatives.
– Damage caused by unsuitable or incompatible appliances, handles, accessories or third-party products.
– Damage caused by wilful damage, abuse, mistreatment, negligence, abnormal storage or environmental conditions, excessive heat, steam, moisture, humidity, water ingress, chemicals, food colourants, cleaning products, ultraviolet (UV) light or natural ageing.
– Reasonable wear and tear, scratches, dents, chips, fading, discolouration or cosmetic deterioration through normal use, household animals or misuse by children.
– Normal adjustment, maintenance or serving of hinges, drawer runners and other moving parts.
– Damage, defects or any failures caused by incorrect, faulty or unsuitable maintenance or installation, whether carried out by the purchaser or any third party.
– Consequential or indirect loss, including the cost of removing or reinstalling products, decorating, plumbing, electrical work or any associated labour costs.
– Commercial, business, trade, rental, buy-to-let, serviced accommodation, student accommodation, holiday-let, short-term letting, multi-occupancy, shared-living, display, exhibition, institutional or any other non-domestic use, or any use other than ordinary private residential use by the original purchaser.
IMPORTANT LIMITATION
– This Guarantee covers the repair or replacement of defective Eligible Smile Kitchens Furniture only. It does not cover the costs of removal, reinstallation, transportation, decorating, plumbing, electrical works or any other associated labour or third-party costs.
To the fullest extent permitted by law, Smile Kitchens’ obligations under this Guarantee are limited to the remedies expressly set out in this Guarantee. Smile Kitchens is not responsible under this Guarantee for the installation of Eligible Smile Kitchens Furniture by any third party.
Our Commitment
Subject to these Terms & Conditions, Smile Kitchens Limited guarantees Eligible Smile Kitchens Furniture for a period of 25 years from the date the Products are delivered to, or taken possession by, the original customer.
Where a valid claim is accepted, Smile Kitchens may, at its discretion:
– Repair the defective furniture component;
– Replace the defective furniture component with the same product where reasonably available; or
– Supply the nearest comparable alternative where the original product has been discontinued.
This guarantee is limited to the supply of replacement furniture components only. Replacement products supplied under this Guarantee will be covered for the remainder of the original guarantee period and will not create a new Guarantee period.
Smile Kitchens does not guarantee the continued availability of any particular style, finish, colour or specification of any product throughout the Guarantee period, but will use reasonable efforts to find the nearest comparable alternative for you.
Bespoke Colour Match
Where replacement components are required for a kitchen with a bespoke colour finish, Smile Kitchens cannot guarantee an exact colour match after three (3) months from the original delivery date due to natural ageing, light exposure and material variation.
Smile Kitchens will use reasonable efforts to provide the closest possible match.
Your Statutory Rights
This guarantee is provided in addition to your statutory rights and does not affect any rights you may have under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
